Memories of Motion

These Terms of Service apply when you visit, use or buy from the Memories of Motion website. They should be read together with our Privacy Policy, Returns and Refunds Policy, Shipping Policy and any product-specific information shown at checkout.

The terms "Memories of Motion", "we", "us" and "our" refer to the business operating this store and website.

Our store is powered by Shopify, which provides the ecommerce platform that enables us to sell our products and services to you.

2. These Terms

By visiting, using or placing an order through our website, you agree to these Terms of Service. If you do not agree to these Terms, please do not use the website or place an order.

If you are a consumer, nothing in these Terms affects your statutory rights under UK consumer law, including your rights where goods are faulty, not as described, not of satisfactory quality or not fit for purpose.

If there is a conflict between these Terms and a product page, checkout notice or policy that gives you stronger consumer protection, the wording that gives you the stronger protection will apply.

3. Access, Accounts and Your Information

You must be at least 18 years old, or have permission from a parent or guardian, to use our website and place orders.

When you create an account, place an order or contact us, you must provide information that is accurate, current and complete. This may include your name, email address, billing address, delivery address and payment information.

You are responsible for keeping any account login details secure and for activity that takes place through your account. Please contact us promptly if you believe your account has been accessed without permission.

4. Our Products

Memories of Motion sells railway, transport, photography, print, book and related products. Some products are printed, stocked or supplied directly by us. Other products are produced or fulfilled by specialist partners, which may include Loxley Colour, Printful and Inkthreadable.

We try to describe and display all products accurately. However, colours, contrast, crop, finish and apparent product size may vary depending on your screen, device settings, print process, material, paper stock, frame, garment, production method or supplier availability.

Product descriptions, images, prices, options and availability may change without notice. We may withdraw or change a product, option or promotion at any time before we accept your order.

5. Made-to-Order, Personalised and Supplier-Fulfilled Products

Many photographic prints, wall art products, apparel, accessories and print-on-demand items are produced specifically for your order. Some may be personalised, customised, cropped, sized, framed, printed or otherwise made to your specification.

Please check all product options carefully before ordering, including image, size, crop, finish, frame, garment size, colour, delivery address and any personalised details. Once production has started, we may not be able to cancel or change made-to-order, personalised, customised or supplier-fulfilled products.

Supplier production rules and claim windows may affect how quickly we need you to report an issue. For example, Printful requires misprinted, damaged or defective product claims to be reported within 30 days of receipt, and lost-in-transit claims within 30 days after the estimated delivery date. Inkthreadable products are printed to order and supplier fault claims should be raised promptly. These supplier processes do not remove your statutory rights with Memories of Motion.

Your contract is with Memories of Motion. Our suppliers and fulfilment partners are not responsible for your contract with us unless they separately agree otherwise.

6. Books

Books printed, stocked or supplied directly by Memories of Motion are treated separately from personalised, customised and made-to-order print products.

Book availability, cover artwork, page count, format, edition, price and delivery options may change from time to time. If a book is listed as a pre-order or back-order, the expected publication or dispatch timing will be an estimate unless we state otherwise.

Returns for books are handled under our Returns and Refunds Policy.

7. Orders and Contract Formation

When you place an order, you are making an offer to buy the products in your basket. We may accept or decline your order.

Your order is accepted when we confirm acceptance or dispatch the goods, whichever happens first. An automated order acknowledgement means we have received your order; it does not necessarily mean we have accepted it.

We may decline, cancel or limit an order where a product is unavailable, there is an obvious pricing or description error, payment is not authorised, delivery is unavailable, fraud checks fail, the order appears to be for resale, the order would breach these Terms, or we are otherwise unable to fulfil it.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

8. Prices and Payment

Prices are shown in pounds sterling unless stated otherwise. Prices, discounts and promotions may change without notice, but changes will not affect orders that we have already accepted.

The price you pay will be the price shown at checkout when you place your order, plus any delivery charges, taxes, duties or other charges shown or explained before you pay.

Memories of Motion is not currently VAT registered, so VAT is not charged on our sales.

You must use a payment method that you are authorised to use. Payment is processed through Shopify and/or third-party payment providers. We do not store full card details on our own systems.

9. Shipping, Delivery and Risk

Shipping options, estimated delivery times and delivery charges are shown at checkout or in our Shipping Policy. Delivery times are estimates unless we expressly state that a delivery date is guaranteed.

Some orders may be shipped in separate parcels, especially where products are fulfilled by different suppliers. Separate parcels may arrive on different days.

For consumer orders, risk in the goods passes to you when the goods are delivered to you, or to someone identified by you to receive them. If you arrange your own carrier independently of the delivery options we offer, risk may pass when the goods are handed to that carrier.

You are responsible for giving us a complete and accurate delivery address. If an order is delayed, returned or lost because the address you provided was incomplete or incorrect, you may be responsible for any reasonable re-delivery or replacement costs unless we are at fault.

10. Returns, Cancellations, Refunds and Gift Cards

Returns, cancellations, exchanges and refunds are handled under our Returns and Refunds Policy.

Some goods cannot usually be cancelled, returned or exchanged for change of mind once production has started, including personalised goods, customised goods, goods made to your specification and certain print-on-demand products. This does not affect your statutory rights where goods are faulty, damaged, incorrect or not as described.

Gift cards are non-refundable and cannot be returned, exchanged or redeemed for cash, except where required by law.

11. Your Submitted Content

If you upload, send or provide text, images, photographs, artwork, logos, files, instructions or other content for a personalised or custom order, you confirm that you own that content or have permission to use it for the order.

You grant Memories of Motion and our suppliers a limited licence to use that content for the purpose of processing, producing, fulfilling, delivering, supporting and evidencing your order. This licence includes sharing the content with fulfilment partners where needed to produce or deliver the goods.

You must not submit content that infringes anyone else's rights, is unlawful, defamatory, abusive, obscene, discriminatory, misleading, malicious, or otherwise unsuitable for production. We may refuse or cancel orders that include such content.

12. Intellectual Property

All website content, product photography, product descriptions, book content, artwork, graphics, logos, designs, videos, audio, text, layout and branding on our website are owned by Memories of Motion, our licensors or our suppliers, unless stated otherwise.

You may use our website for personal, non-commercial shopping and browsing. You must not copy, reproduce, publish, distribute, adapt, scrape, train AI systems on, commercially exploit or create derivative works from our website content or products unless we give written permission or the law allows it.

Buying a product from us does not transfer copyright or other intellectual property rights in any image, book, design, artwork or content. Purchased products are for personal use unless we expressly agree otherwise in writing.

Shopify, Loxley Colour, Printful, Inkthreadable and other third-party names, logos, product names and marks belong to their respective owners.

13. Reviews, Feedback and Communications

If you submit a review, comment, suggestion, photograph or other feedback to us, you confirm that it is honest, lawful and does not infringe anyone else's rights.

You give us permission to use, reproduce, display, edit and share your submitted review or feedback for operating, improving and promoting Memories of Motion, including on our website, emails, social media and marketing materials. We will handle personal information in accordance with our Privacy Policy.

We may moderate, edit, remove or decline to publish reviews or feedback where we reasonably believe they are unlawful, offensive, misleading, irrelevant, infringing or otherwise unsuitable.

14. Optional Tools and Third-Party Links

Our website may include links, embedded content, payment tools, shipping tools, review tools, analytics tools or other services provided by third parties. We are not responsible for third-party websites or services that we do not control.

If you use a third-party tool or follow a third-party link, that third party's own terms and privacy notices may apply.

15. Relationship with Shopify

Memories of Motion is powered by Shopify, which enables us to provide our online store. However, sales and purchases made through our store are made directly with Memories of Motion.

By using our website, you acknowledge that Shopify is not responsible for any aspect of a sale between you and Memories of Motion, including any issue, damage or loss arising from purchased products or services, except to the extent Shopify is responsible under applicable law.

16. Privacy

Personal information collected through our website is handled under our Privacy Policy. Because our store is powered by Shopify, Shopify may also collect and process personal information to provide, secure and improve the ecommerce services used by our store.

17. Errors, Inaccuracies and Availability

Occasionally, information on our website may contain errors, inaccuracies or omissions relating to product descriptions, images, prices, promotions, delivery charges, delivery estimates, availability or other details.

We may correct errors, update information, change availability or cancel orders affected by obvious errors. If your order is cancelled after payment has been taken, we will refund the cancelled item or order.

18. Prohibited Uses

You must not use our website or services:

  • For any unlawful, fraudulent, harmful or malicious purpose.
  • To infringe our rights or the rights of anyone else.
  • To upload or transmit viruses, malware or harmful code.
  • To harass, abuse, defame, threaten, mislead or discriminate against any person.
  • To scrape, extract, copy, resell or commercially exploit our website, data, images, product descriptions or content without permission.
  • To interfere with the security, availability or proper working of the website.
  • To place orders using false, incomplete or misleading information.

We may suspend or restrict access to the website, cancel orders or take other appropriate action if we reasonably believe these Terms have been breached.

19. AI Agents, Scrapers and Automated Access

You must not use bots, scrapers, crawlers, automated purchasing tools, agentic AI systems or other automated means to access, copy, monitor, test, order from or interact with our website in a way that breaches these Terms, ignores technical restrictions, overloads our systems, misrepresents the source of traffic, or infringes our rights.

Any permitted automated access must identify itself truthfully, respect robots.txt and other technical controls, and stop accessing our services if we ask it to do so.

20. Suspension and Termination

We may suspend, restrict or terminate your access to our website if you breach these Terms, misuse the website, interfere with the website, infringe our rights or the rights of others, or place orders using false or misleading information.

Termination does not affect rights and obligations that have already arisen, including payment obligations, intellectual property rights, liability provisions and any terms that are intended to continue after termination.

21. Warranties and Disclaimers

We provide our website using reasonable care and skill. We do not guarantee that the website will always be available, uninterrupted, secure or error-free.

Product information on the website is provided for general shopping information. We try to keep it accurate, but we do not guarantee that all website content will always be complete, current or free from minor errors.

Nothing in these Terms excludes or limits your statutory rights as a consumer, including your rights where goods are faulty, not as described, not of satisfactory quality or not fit for purpose.

22. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory consumer rights, or any other liability that cannot legally be excluded or limited.

If you are a consumer, we are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable, losses caused by your breach of these Terms, or business losses where you bought goods as a consumer for personal use.

If you buy from us as a business, we will not be liable for loss of profit, loss of revenue, loss of business, business interruption, loss of goodwill, loss of data or indirect or consequential losses. Our total liability to a business customer for an order will not exceed the amount paid for that order, except where the law does not allow such a limit.

23. Indemnity for Business and Submitted Content

If you are acting as a business, or if you provide content for a custom or personalised order, you agree to reimburse us for reasonable losses, costs, claims and expenses we suffer because your submitted content infringes someone else's rights, is unlawful, or breaches these Terms.

This does not affect any statutory rights you have as a consumer.

24. Changes to These Terms

We may update these Terms from time to time by posting a new version on this page. The version that applies to your order will usually be the version in force when you placed that order.

If we make material changes that affect your ongoing use of an account or service, we will take reasonable steps to bring those changes to your attention.

25. Severability, Waiver and Assignment

If any part of these Terms is found to be unlawful, invalid or unenforceable, the remaining parts will continue to apply.

If we do not enforce a right immediately, that does not mean we have waived it.

You may not transfer your rights or obligations under these Terms without our written permission. We may transfer our rights and obligations under these Terms to another organisation, provided this does not reduce your consumer rights.

26. Governing Law and Disputes

These Terms are governed by the laws of England and Wales.

If you are a consumer living in Scotland, Northern Ireland or another country, you may also have the right to bring proceedings in your local courts and to rely on mandatory consumer protections that apply where you live.
